The Adventure Express knows that you take your privacy seriously, which is why we intend to be transparent with you about our data practices and give you control over the information we collect about you. This is the Privacy Policy of The Adventure Express and its wholly-owned subsidiaries.

1.1. Information we collect and how we use it

Your request must be accompanied by the following:

  • A photograph or scan of your official photo ID with your handwritten signature, or, if you are acting on someone else's behalf, a copy of the notarized power of attorney and/or one registered with the corresponding Public Registry, and the articles of incorporation if applicable.
  • A scan or photograph of proof of address.

In your written request, you must:

  • State your name or company name and provide a physical address for delivery of the response, communications, documentation, and replies;
  • Let us know which Personal Data you wish to access, or wish to have rectified, canceled, or reviewed, as well as any objection to processing or revocation of consent;
  • State whether you know or recall the purpose for which you provided the data and the name of the party responsible to whom you gave it; and
  • Clearly, respectfully, and concisely state your request, along with any other information or document that would help locate your Personal Data.

The Adventure Express will have a period of twenty days, counted from receipt of the request, to resolve it or request further information. Should your request be deemed valid — because you established your identity and your Personal Data was found in our database — it will be carried out within no more than fifteen days. The Adventure Express will keep you informed of the process whenever you request it.

The response and access to your Data, along with supporting documents, may be delivered to you, upon proof of identity and/or authority, through copies certified by the Committee and your legal representative, electronic documents, or plain copies. Whenever the request is made through electronic means, those means will be given preference for sending responses and resolutions.

Should The Adventure Express need to use your Personal Data for purposes other than those stated in this Privacy Notice, we will contact you in writing, by phone, electronically, or by any optical, audio, visual, or other means that technology now or in the future allows, and will explain the new uses intended for that information in order to obtain your consent.

1.3. Data collected when you use our consumer services

If you choose to opt in, we automatically receive data about your location and/or IP address each time you interact with or use the Consumer Services. We use various technologies to determine your location, such as your operating system's or browser's location services, your device's sensor data (for example, magnetometer or barometer data, Bluetooth data, beacon data, Wi-Fi access points, GPS data, and cell tower data), and other data that may help us understand your precise location.

We may also collect additional data about you when you use the Consumer Services. For example, we collect data:

  • Relating to how you interact with the Consumer Services, such as search terms, pages you visit, access times, time spent on each page, your IP address, redirected pages, or any messages you write to other users, or post on the Consumer Services;

  • Collected through cookies and other technologies, such as cookie IDs, advertising IDs, web beacons, local storage, and pixels.

If you use our applications and have enabled background location services within them, you have allowed us to collect the above data about you in the background, even when the apps aren't open (as permitted by your device settings). You can disable location services at any time by accessing your device settings and turning off background location.

1.4. Data collected from third parties

We may collect data about you through third parties, including Clients and/or third parties whose services interact with the Consumer Services or who provide services to us, such as unaffiliated apps and websites. This data may include data about your activity when using the Consumer Services or on unaffiliated websites and apps, or data received from web browsers or operating systems, such as browser types and settings, operating systems, device models, carriers, location information, IP address, mobile devices, and advertising identifiers.

1.5. Use of data

We may use your data for research and development, to improve the Consumer Services or offer new products, features, and tools, but only to the extent this complies with applicable law. We may also use your data to help us map locations. For example, we may use device signals to determine that a particular device is located within a place. Additionally, if you agree to share crash data with us (when apps crash), we may use that data to help us analyze the cause of the crash.

We may use your data to communicate with you, including by email, text message (only if you consent), or within our Apps, about new product offerings, updates to the Consumer Services, or anything else we believe may be of interest to you; however, you may opt out of receiving marketing and promotional communications.

We may also use your data, such as name and phone number, for advertising and promotional purposes, via email or WhatsApp, provided the user accepts this privacy notice.

Protection of our rights: We may use your data to protect the rights, property, or safety of The Adventure Express, the Consumer Services, our users and employees, or any third party. For example, we may use your data if we need to enforce or apply our Terms of Service or Policies.

1.6. Data sharing

We do not rent or sell data about users without their consent unless it is anonymous, aggregated, or pseudonymous. However, as described in more detail in this Privacy Policy, we may license or provide other data to VIRKET and ENVIO CLICK for the fulfillment of the service. Information shared with VIRKET and ENVIO CLICK will receive the same treatment and will not be used for any purpose other than that agreed upon between the parties.

When you use the Consumer Services, your authorized contacts may see some of your information, such as your name, email address, and phone number associated with your account. Except as permitted by this Privacy Policy, we will only share such information with your consent.

2. Cookies

4. Responsibilities

Each user is responsible for handling their customers' personal information, and accordingly agrees to hold ENVIO CLICK/VIRKET harmless from any mishandling of such information. Likewise, The Adventure Express will be liable to third-party subcontractors engaged for the provision of services, and to those for whom it acts as an intermediary, holding all parties involved harmless.

5. Data Security

We use various safeguards to protect the personal information sent to us, both during transmission and once we receive it. However, no method of transmission over the Internet or mobile device, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

6. Children Under 13

The Consumer Services are not directed to individuals under 13 years of age. We do not knowingly collect any data from children under 13. If you observe or suspect that a user is under 13, please contact us immediately at The Adventure Express.

The Adventure Express may modify this Privacy Policy from time to time. We recommend that you regularly review this page for any changes we may make in accordance with this Privacy Policy.
